Mama Takes A Whisk – Customer Agreement

By accessing or using the services provided by Mama Takes A Whisk, and, again, by checking the box, submitting payment, and/or confirming a scheduled delivery, you (the “Client” or “You”) agree to the following terms outlined in this agreement and to be bound by them. If You are using the services on behalf of any person or entity, You represent and warrant that You are authorized to accept these terms on such person or entity’s behalf and that such person or entity agrees to be responsible to us if You or such person or entity violates these terms.

1. Agreement to Terms
Mama Takes A Whisk is a consumer-facing brand of Katie Takes A Whisk LLC (collectively, Mama Takes A Whisk and Katie Takes A Whisk LLC are referred to as “KTAW”). All contracts, invoices, and payments are processed under Katie Takes A Whisk LLC. Client understands that this name may appear on credit card statements and receipts. KTAW reserves the right to change or modify these terms at any time and in its sole discretion. If KTAW makes material changes to these terms, notice of such changes will be provided, such as by sending You an email notification or providing notice through the websites. By continuing to access or use the services in any way after such notice has been provided, You confirm Your acceptance of the revised terms and all of the terms incorporated therein by reference. You are encouraged to review the terms frequently to ensure that You understand the terms and conditions that apply when You access or use the services or order delivery. If You do not agree to the revised terms, You are free to reject them and will not be able to access or use the services.

2. Allergy & Dietary Disclaimer
It is the Client’s responsibility to notify Katie Takes A Whisk LLC prior to placing an order if Client or anyone in their household has severe or life-threatening food allergies.

Due to small-batch production and the use of a shared kitchen, KTAW cannot guarantee an allergen-free environment. Cross-contact with common allergens (including, without limitation, dairy, gluten, nuts, soy, sesame, and eggs) is possible.
Meals are not customizable beyond what is listed in the product descriptions. If You have strict dietary needs, please contact us at mamatakesawhisk@gmail.com before ordering.

3. Food Safety & Client Responsibility
Once meals are delivered or picked-up, KTAW is no longer responsible for food safety.
Client agrees to:

● Refrigerate or freeze meals immediately upon receipt
● Follow all storage and consumption instructions provided
● Discard meals that appear spoiled, have been left out too long, or are consumed past the recommended date

KTAW is not liable for any illness or spoilage due to improper handling after delivery or pick-up. You are responsible for inspecting all meals and products You receive from us for any damage or other issues upon delivery. In addition, You are solely responsible for determining the freshness of the meals
and/or products You receive. From the time of delivery, the condition and consumption of the meals and/or products are solely at Your risk, and You are solely responsible for the proper and safe washing, handling, preparation, storage, cooking, use and consumption of the meals and/or products following delivery.

4. Cancellation & Rescheduling Policy
Due to the planning involved in sourcing and preparing meals for postpartum clients:
● Cancellations must be made at least 14 calendar days prior to the scheduled delivery date to receive a full refund.
● Cancellations within 14 days are non-refundable but may be eligible for rescheduling on a case-by-case basis, based on availability.
● Rescheduling requests must be submitted at least 14 days in advance of the original delivery date and are not guaranteed.
● Missed deliveries or no-shows are not eligible for refunds or credit.

5. Payment Terms
Full payment is required to be made by Client at the time of booking to secure Client’s delivery. Payment further confirms Client’s agreement to these terms.
● Accepted payment methods: Credit card via secure online checkout (Shopify).
● If a payment fails or is declined, Your order will not be confirmed and You will be notified.

6. Delivery/Pick-up
Client must be available to receive his/her/its/their delivery during the agreed-upon time window.

KTAW is not responsible for missed deliveries or pick-ups due to:
● Inaccurate or incomplete delivery information; or
● Client unavailability during the scheduled time.

7. Force Majeure
KTAW is not liable for delays or cancellations caused by events beyond our control, including but not limited to:

● Natural disasters
● Supply chain disruptions
● Public health emergencies
● Illness or injury affecting production or delivery

8. Privacy Policy
Client information is kept confidential and used only for the purposes of:
● Order fulfillment
● Delivery coordination
● Business communication

We do not sell or share Your information with third parties.

9. Nutritional & Medical Disclaimer
While our meals are thoughtfully crafted based on extensive research to support postpartum recovery and lactation, Katie Takes A Whisk LLC, Mama Takes A Whisk, and its chefs, writers, and publishers are not doctors, nutritionists, dietitians, or any kind of medical professionals, and do not provide medical or licensed nutritional advice. Any statements contained in this website should not be considered medical or nutritional advice and should not be considered a substitute for professional
medical expertise. None of this content is intended to cure, prevent, diagnose or treat any disease or condition. Statements within this site have not been evaluated or approved by the Food and Drug Administration. If You think you have any type of medical condition, You should seek professional medical
advice.

KTAW is not liable or responsible for any loss, adverse reactions, effects, consequences, damage, affliction or illness to food consumed, or resulting in Your reliance on the content provided here (such as recipes and nutritional information).

10. Stock Photography Disclaimer
Some images used on our website, menu, or promotional materials may be stock or representative photos. While we strive for accuracy in our descriptions, the actual appearance of meals may vary.

This disclaimer applies to all product photos unless otherwise noted.
All non-stock images and photographs are proprietary property of KTAW and may not be used, published, reproduced, repurposed, distributed, or displayed in any manner, without KTAW’s prior written consent.

Client Acknowledgment
By checking the box at checkout and/or submitting payment, Client acknowledges and agrees that:
● Client understands the risk of potential allergen exposure
● Client is solely responsible for the proper storage and handling of meals once delivered or picked up
● Client is not permitted to resell or otherwise use the meals and/or products for commercial purposes
● Client has read, understood, and agree to all cancellation, payment, and delivery terms outlined above
